Privacy law
Every organization in the Netherlands is affected by Privacy law in various degrees. European and Dutch legislation impose obligations on personal data processing. This may be data of your customers, patients, pupils/students, employees or applicants.
Privacy issues exist in every aspect of the organization. In HRM, legal affairs, IT, marketing, administration, or in a cooperation with or acquisition of a different enterprise. That is why it is necessary to view the organization as one entity and consider it from various fields of law. Our privacy law section realizes this by the combination of expertise from labour law, employee participation law and corporate law.
Providing proper arrangements for privacy means: reducing risks. A data breach may cause considerable reputational damage. An incorrect provision in a contract may lead to unnecessary liability. A failure to (properly) involve the works council may result in inability to implement the required actions or policies. Not acting in accordance with the GDPR may cause the Data Protection Authority to impose a (stiff) penalty.
Privacy issues require strategic action. How far do you wish or need to go as an enterprise? Privacy law is not always either black or white and requires a correct explication and interpretation. Our lawyers have known the workings of privacy law for years and years, which enables them to provide the legally and practically most suitable advice. For IT law and IP law we work together with specialized partners.
